1. Agreement to Terms

By accessing or using Whatcha Watch ("the Service"), available at whatchawatch.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including during our pre-launch waitlist phase.

2. Description of Service

2.1 Current Phase

Whatcha Watch is currently in pre-launch phase. During this period, we are collecting waitlist signups and preparing for our official launch in Q1 2026.

2.2 Future Service

When launched, Whatcha Watch will provide a social platform for tracking and sharing movies, TV shows, and other visual media content with friends. Features will include watch tracking, ratings, reviews, social feeds, and data import from third-party services like Letterboxd and IMDb.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Waitlist Terms

By joining our waitlist, you agree that:

  • You are providing accurate and complete email information
  • You consent to receive email communications about our launch and product updates
  • Waitlist position does not guarantee access or features
  • We reserve the right to modify waitlist access at our discretion
  • You may request removal from the waitlist at any time

5. User Accounts

5.1 Account Creation (Future)

When the Service launches, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

5.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

6. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Harass, abuse, threaten, or discriminate against others
  • Post false, inaccurate, misleading, or fraudulent content
  • Spam, distribute malware, or engage in phishing activities
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Scrape, crawl, or use automated tools without permission
  • Infringe on intellectual property rights of others
  • Impersonate any person or entity

7. Intellectual Property

7.1 Our Content

The Service and its original content (excluding user-generated content), features, and functionality are owned by Whatcha Watch and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content (Future)

When you post content on the Service (reviews, ratings, comments, etc.), you retain ownership but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your content in connection with the Service.

7.3 Third-Party Content

Movie posters, metadata, and related content are sourced from third-party services and databases. We do not claim ownership of this content and use it under fair use or applicable licenses.

8. Third-Party Services and Links

The Service may contain links to third-party websites or services (such as Letterboxd, IMDb, or TMDB) that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.

9. Disclaimers and Limitation of Liability

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Warranty

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHATCHA WATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL ARISING OUT OF YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify, defend, and hold harmless Whatcha Watch, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or violation of any rights of another.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if provided) or by posting a notice on the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Whatcha Watch operates, without regard to its conflict of law provisions.

14. Dispute Resolution

14.1 Informal Resolution

In the event of any dispute arising out of these Terms, you agree to first contact us at hello@whatchawatch.app to attempt to resolve the dispute informally.

14.2 Arbitration

If informal resolution is not successful, any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Whatcha Watch regarding the use of the Service and supersede any prior agreements.
